Terms of Use
Terms and conditions for using our website and services
Last updated: January 2024
Agreement to Terms
By accessing or using the calm-invest website and services, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you should not use our website or services.
These terms apply to all visitors, users, and clients of calm-invest. We may revise these terms at any time by updating this page. Your continued use of the website following changes constitutes acceptance of the revised terms.
About Our Services
calm-invest provides benefits advisory services, including guidance on eligibility for UK welfare benefits, support with benefit applications, and assistance with appeals and reconsiderations.
Our services are advisory in nature. We provide information and guidance to help you understand and navigate the benefits system. We do not guarantee any particular outcome from benefit applications or appeals, as decisions are made by the Department for Work and Pensions, local authorities, or tribunals.
Not Legal Advice
The information and guidance provided by calm-invest constitutes benefits advice, not legal advice. While our advisors are trained in welfare rights, they are not solicitors or barristers.
For complex legal matters, particularly those involving judicial review or Upper Tribunal appeals, we may recommend you seek advice from a solicitor or legal aid provider. We can provide referrals where appropriate.
Website Information
The information on this website is provided for general informational purposes. While we strive to keep the content accurate and up to date, benefits regulations change frequently. The information on this website may not reflect the most recent changes.
This website does not constitute advice about your specific circumstances. For personalised guidance, please engage our consultation services or contact us directly.
Service Engagement
Engaging our paid services creates a client relationship governed by these terms and any specific service agreement provided at the time of booking.
Your Responsibilities
When engaging our services, you agree to:
- Provide accurate and complete information about your circumstances
- Inform us promptly of any changes to your situation
- Respond to requests for information in a timely manner
- Pay fees as agreed at the time of service engagement
- Not misuse our services for fraudulent purposes
Our Responsibilities
We will:
- Provide services with reasonable care and skill
- Keep you informed about the progress of your case
- Maintain confidentiality of your information
- Provide accurate advice based on the information you give us
- Act in your best interests within the scope of our engagement
Fees and Payment
Service fees are quoted in Pounds Sterling and must be paid as agreed at the time of booking. We accept payment by bank transfer and major credit/debit cards.
Fees cover the specific services described at the time of engagement. Additional services or extended support may incur additional charges, which will be discussed with you before being incurred.
We do not charge success fees based on benefit awards. Such fees are prohibited by regulations and we consider them unethical in the context of benefits advice.
Cancellation and Refunds
You may cancel a booked consultation with at least 48 hours notice for a full refund or to reschedule. Cancellations with less than 48 hours notice will forfeit 50% of the consultation fee.
If you are dissatisfied with our services, please contact us within 14 days. We will review your concerns and may offer a partial refund at our discretion if our services did not meet reasonable expectations.
Refunds are not available simply because a benefit application was unsuccessful, as we cannot guarantee outcomes of applications made to third-party decision makers.
Limitation of Liability
To the fullest extent permitted by law, calm-invest shall not be liable for:
- Decisions made by the DWP, local authorities, or tribunals regarding your benefit claims
- Delays in benefit processing by government departments
- Any indirect, consequential, or special damages arising from use of our services
- Losses arising from information you provided that was incomplete or inaccurate
Our total liability for any claim arising from our services shall not exceed the fees you paid for the specific service giving rise to the claim.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
